"The challenged right for primary purchase is nullified and not valid. According to this Crispian is obliged to refuse alienation of actions. RUSAL has the right to declare it" — it was said in the judgment. The transaction in court was challenged by the RUSAL company of Oleg Deripaska. The company is also a shareholder of Norilsk Nickel. Earlier Potanin's structure of Bonico Holdings Co has made the proposal to Abramovich's Crispian about repayment at him 3,99% of stocks of Norilsk Nickel at the price of $234 for an action / $23,4 for ADR (with an award in 12% to the closing price of LSE on February 15). Crispian according to the shareholders' agreement has suggested Interros and RUSAL to buy this package in proportion to their shares in the company — Interros of 2,1%, RUSAL — 1,9% of stocks. Deripaska's structures have challenged this transaction in the High Court of Justice, but have agreed to the offer of Crispian and Whiteleave in court not to block sale of 4% of Norilsk Nickel. The essence of arrangements was that the court has to decide destiny of the transaction — if it recognizes that she violates the shareholders' agreement of Norilsk Nickel, the transaction will be cancelled. Potanin's Whiteleave at the end of March has closed the transaction on purchase of 2,1% of stocks of Norilsk Nickel from Crispian. The source of one of the parties said RNS earlier that if the transaction is recognized illegitimate, then actions and money for them will be returned.
