The High Court of Justice will consider the claim of Tatneft to Kolomoysky in 2020 — Rambler News Service


The High Court of Justice in 2020 will repeatedly consider the claim of Tatneft to the Ukrainian businessmen Igor Kolomoysky, Gennady Bogolyubov, Alexander Yaroslavsky and Pavel Ovcharenko who concerns embezzlement of the Ukrtatnafta company, follows from materials of the Russian oil company. "On the basis of the decision of Court of Appeal the claim of Tatneft will be considered in essence by the High Court of Justice in the fall of 2020" — the company notes. On March 23, 2016 Tatneft initiated judicial proceedings in England against businessmen Gennady Bogolyubov, Igor Kolomoysky, Alexander Yaroslavsky and Pavel Ovcharenko. In the submitted claim the company states that in 2009 specified persons appropriated in the fraudulent way the money which were due to Tatneft for the oil put on the Kremenchuk oil refinery (Ukrtatnafta company). The company demands compensation of damage of $334.1 million and percent (in total the sum of the claim is $380 million). The High Court of Justice refused on November 8, 2016 to Tatneft the claim. On October 18, 2017 the Court of Appeal of England and Wales decided to satisfy in full the appeal of the Russian company and cancelled the decision of the High Court of Justice. Tatneft also notes that in May, 2019 the appeal of Ukraine on other lawsuit — about recognition and carrying out of the decision of the International commercial arbitration which decided to exact on July 29, 2014 from Ukraine $144 million in favor of the Russian company will be considered. Production on consideration of other objections of Ukraine on recognition and carrying out of the arbitral award in England and Wales is suspended for appeal. It is about compulsory execution of the arbitral award of July 29, 2014. The basis for decision was the fact that Ukraine violated the bilateral agreement about encouragement and mutual protection of investments between Russia and Ukraine and deprived Tatneft of its equity in the largest oil refinery in Ukraine — Kremenchuk. In April, 2017 Tatneft submitted the petition for recognition and carrying out of the decision of tribunal to the High Court of England and Wales. In May, 2017 the High Court satisfied the petition of Tatneft. Ukraine was granted the right for the appeal of this decision of the High Court in Court of Appeal only on one basis (at the same time it is refused on all rest).
